Below are attachment of Attorney Michele Rosenfeld’s comments that she sent to the Planning Staff on the following dates:
9/17/25 - The first letter makes 3 points: (1) the Commercial Residential Neighborhood Floating Zone (CRNF) is the wrong zone for this location, (2) no prior rezoning under the CRNF was all residential or surrounded by all residential neighborhood, and (3) the “surrounding neighborhood” that the developer drew was too big and should not include the Giant and townhomes behind the Giant. 10/7/25 - The second letter focuses on the 1997 Master Plan as amended in 2014 and Thrive Montgomery 2050. The letter uses the language of the Master Plan and Thrive to show how this rezoning attempt does not conform with either plan. View letter here.
10/13/25 - The third letter makes 4 additional points: (1) the proposed rezoning is “not compatible” with the neighborhood because of the proposed height (50 feet) and open space (only 10%), (2) the proposed rezoning will “adversely affect the character” of the neighborhood by resulting in overflow parking and cut-through traffic, and (3) not having an entrance/exit on New Hampshire will overburden Notley Road. Finally, (4) the increased traffic would materially impair public safety and the developer’s traffic study is flawed. View letter here.
